Right now, if a small drone operator wants to fly a package to a customer's porch, inspect three miles of pipeline, or spray a back forty acres, federal law requires a human to keep eyes on that aircraft the entire time — or spend months and tens of thousands of dollars chasing an individual waiver from the FAA. That's about to change. A new rule called Part 108 is working its way through the federal rulemaking process, and it's the biggest shift in small-drone regulation since Part 107 legalized commercial drone flying back in 2016.
For small inspection companies, delivery startups, and agricultural operators, Part 108 isn't a footnote in an aviation trade publication. It's the difference between a business model that scales and one that's permanently capped by how far a single pilot can see.
What Part 108 Actually Is
Part 108 is the FAA's proposed framework for BVLOS operations — drone flights conducted "beyond visual line of sight," meaning no human observer has to keep the aircraft in view. Today, BVLOS flying is technically legal but practically rare, because it requires an individual waiver under Part 107 rules, and the FAA grants those sparingly and slowly.
The FAA published the Part 108 Notice of Proposed Rulemaking on August 7, 2025. A 60-day public comment period closed on October 6, 2025, drawing more than 3,000 responses — enough that the agency reopened a narrower comment window in January 2026 focused on collision-avoidance and electronic-conspicuity requirements. Industry trackers now expect a final rule around spring 2026, with actual implementation following six to twelve months after that. In practical terms: this is not hypothetical, but it's also not live yet. Treat 2026 as the year to prepare, not the year to assume you're already compliant.
The core change is philosophical as much as technical. Part 107 was built around a pilot maintaining visual awareness of a single aircraft. Part 108 assumes autonomous or semi-autonomous operations where a small team oversees a fleet, and it replaces one-off waivers with a standardized, scalable approval process — closer to how the FAA certifies an airline than how it licenses an individual pilot.
Two Tracks: Permitted vs. Certificated Operations
Part 108 doesn't apply one rulebook to every operator. It scales requirements to risk, which is exactly where it matters for a small business trying to decide whether this rule helps or buries them in paperwork.
Permitted Operations are the lower-risk, lower-barrier track:
- Valid for 24 months once approved
- Requires 120 days advance notice before operations begin
- Package delivery capped at 100 aircraft, under 55 lbs
- Agricultural spraying/seeding capped at 10 aircraft
- Aerial survey work capped at 25 aircraft
- No hazardous materials allowed
Certificated Operations are for higher-risk work — heavier aircraft, hazmat payloads, flights over dense population areas, or fleets larger than the Permitted caps allow. This track requires a full FAA evaluation: a designated training program, a safety management system, hazmat training, and no cap on aircraft count. It's a heavier lift, but it's also the only path for a delivery company that wants to scale past 100 drones or an ag operator running a fleet larger than 10.
Both tracks introduce two new personnel roles worth knowing before you budget for this: an Operations Supervisor (overall safety authority) and a Flight Coordinator (tactical oversight, requiring a minimum 5 flight hours on the specific aircraft model and 5 hours of currency every 12 months). Both roles carry TSA background-check requirements. If you're a two-person inspection shop today, this is the clearest signal that Part 108 assumes you'll need to formalize roles you may currently be handling informally.
Where the Real Requirements Bite
The proposed rule sets hard aircraft limits — maximum 25-foot wingspan, 1,320 lbs, 87 knots ground speed — and layers on detect-and-avoid systems, redundant power and propulsion, anti-collision lighting visible from 3 statute miles, and cybersecurity protections. Before an aircraft type can fly under a permit, it needs 150+ hours of flight testing behind it.
Operations approval also depends on population density, split into five categories — from Category 1 (beyond 1 statute mile from any group of 10+ people) up to Category 5 (within half a mile of 2,500+ people, which requires automatic detect-and-avoid and the tightest scrutiny). A rural pipeline inspection and an urban delivery route are not the same regulatory conversation, and the paperwork reflects that.
There's also an operational discipline layer that reads more like a trucking regulation than a drone rule: personnel duty limits of 14 hours/day and 50 hours/week, mandatory 10-hour rest periods, monthly flight-data reporting, emergency-event reporting within 10 days, and security-incident reporting within 96 hours. A comprehensive operations manual covering maintenance, emergencies, and hazmat handling is required regardless of track.
None of this is arbitrary bureaucracy — it's the FAA's answer to "how do we trust a drone flying itself over a school or a highway." But it does mean the compliance overhead for a small operator is real, and it's exactly the concern industry groups like the Drone Service Providers Alliance raised in comments: that safety management systems, enhanced training, and detect-and-avoid technology costs risk favoring large, well-capitalized companies over small ones. Why the Industries That Bookkeeping Clients Are In Should Care
Three sectors show up repeatedly in the FAA's own framing of who Part 108 is for, and all three overlap heavily with the kind of small and mid-size businesses that read this blog.
Infrastructure and inspection. Aerial survey operations are permitted up to 1,320 lbs even in higher-density areas, and "shielded operations" allow flying within 50 feet of structures for powerline, pipeline, and bridge inspection. The economics here are already proven under today's harder-to-get waivers: a 2026 cost analysis of a 77-mile transmission-line BVLOS survey put costs at roughly $61 per mile and $152 per hour, versus helicopter inspection costs commonly cited in the $1,200–$1,500 per mile range — a 50–70% cost reduction industry-wide. One pipeline operator reported cutting response time to potential leaks from 18 days to 4 hours after adopting drone-based monitoring, preventing six major incidents in a single year. Part 108 is what turns that kind of program from "requires a special federal waiver" into "standard operating procedure available to a regional inspection firm."
Agriculture. The permitted-operations track allows up to 10 aircraft for seeding, spraying, and fertilizing — without needing separate Part 137 aerial-application certification. For a farm services business currently limited to line-of-sight spraying (one field at a time, one operator watching), this is a direct path to covering more acreage per labor-hour.
Delivery and logistics. Package delivery under Permitted Operations scales to 100 aircraft under 55 lbs; Certificated Operations remove that cap entirely and allow hazmat payloads. This is the track most reported on nationally (the big-name delivery pilots), but the framework is explicitly built to be available to regional and local operators too, not just national players.
What Small Operators Are Pushing Back On
The comment period wasn't a formality — it surfaced the exact tension small businesses should watch closely. The Drone Service Providers Alliance and a coalition of commercial and recreational operators argued that requiring individual FAA review and approval for every operational area risks recreating the same slow, case-by-case waiver bottleneck Part 108 was supposed to replace. Their proposed fix: let operators self-assess against clear, objective criteria instead of waiting on a reviewer for each new area of operation. Commenters also questioned whether detect-and-avoid technology is mature — or affordable — enough yet for a small fleet operator to deploy at the standard the rule expects from day one.
None of that means the rule will change dramatically before finalization, but it's a preview of where enforcement friction is likely to show up first: not in the broad framework, but in exactly how "routine" area approvals turn out to be in practice, and how much a smaller shop has to spend on detect-and-avoid hardware relative to a national delivery operator.
What to Do Between Now and the Final Rule
You can't file for a Part 108 permit yet — the rule isn't final. But the businesses that will move fastest once it is are the ones doing groundwork now:
- Track the comment docket and final-rule timeline rather than relying on secondhand summaries, since details (especially around detect-and-avoid and right-of-way provisions) are still being negotiated.
- Map your operations against the two tracks now. If your aircraft, payload, and area of operation fit within Permitted Operations caps, your compliance lift will be far smaller than if you need a full Operational Certificate.
- Start building the paper trail Part 108 will expect — training records, maintenance logs, incident reports — even under today's Part 107 rules. An FAA reviewer evaluating a new permit application will want to see operational maturity, not a business that started keeping records the week the rule took effect.
- Budget for the personnel requirements, not just the equipment. An Operations Supervisor and a currency-qualified Flight Coordinator are new line items for a lot of small shops.
