Wait — Is There a Federal Heat Rule or Not?
Not exactly, and that's the source of a lot of confusion. OSHA's proposed Heat Injury and Illness Prevention Standard has been in the rulemaking pipeline since August 2024. Public hearings wrapped up in late 2025, the post-hearing comment period closed on October 30, 2025, and the rule is still sitting unfinished with no confirmed finalization date.
So there is no final, standalone federal heat standard right now. But two things fill that gap, and both have teeth:
- The General Duty Clause. The Practical Thresholds Inspectors Look For

- 80°F heat index — initial trigger. Cool drinking water, shade or a cool rest area, and basic monitoring should already be in place.
- 90°F heat index — high-heat trigger. Add scheduled rest breaks, more frequent hydration reminders, and active monitoring of workers for early symptoms (heavy sweating, dizziness, confusion, cramping).
Acclimatization: The Detail Most Small Employers Miss
A large share of heat illness incidents happen in a worker's first days on the job, before their body adjusts to sustained heat exposure — including for returning employees after a vacation, illness, or seasonal layoff. A defensible acclimatization schedule looks like this:
- Day 1: no more than 20% of a normal full shift's workload in the heat
- Days 2–14: increase workload by roughly 20% each day until the worker reaches full duty
If your business has any seasonal hiring pattern — landscaping crews ramping up in spring, restaurant kitchens adding summer staff, construction subs bringing on day laborers — this is the single most commonly missed requirement in an inspection.
Building a Written Heat Illness Prevention Plan
You don't need outside counsel to put together a defensible plan. At minimum, document:
- A named Heat Safety Coordinator — someone responsible for monitoring the forecast and heat index, not just reacting after someone feels sick
- Water access — cool water within reasonable reach of every work area, with additional electrolyte-containing fluids for shifts of two hours or more

- An emergency response procedure — who calls 911, who has first-aid training, how a remote crew reaches help

If you operate in one of the following states, federal guidance is the floor, not the ceiling — these states have enforceable, binding heat standards with their own citation authority:

Minnesota is sometimes grouped with this list but its rule is narrower — it addresses indoor industrial and agricultural heat exposure through ventilation and equipment controls rather than outdoor work.
